These Terms and Conditions govern access to and use of carlosimpson.com, the Carlos Simpson Art online shop, creative services, commissions, publications and other services made available through this website.
Important: these Terms should be read together with the product or service information shown at the point of purchase, the Refund & Returns Policy, the Artwork Rights, Image Licensing & AI Use Policy, the Cookie Policy and any written commission, licensing or project agreement that applies to a specific transaction. Nothing in these Terms limits rights that cannot lawfully be excluded, including statutory consumer rights.
Scope and acceptance
These Terms and Conditions govern your use of carlosimpson.com and, where applicable, purchases, enquiries, commissions, digital content, publications and other creative services offered through the website.
By using this website you agree to use it in accordance with these Terms and applicable law. When you place an order, request a commission, purchase a service or enter into a separate written agreement, additional transaction-specific terms may also apply.
If a separate signed or expressly accepted agreement conflicts with these general Terms, that specific agreement takes precedence for the subject matter it covers.
Carlos Simpson Art and this website
Carlos Simpson Art is the art and ecommerce presence published through carlosimpson.com and associated with the creative practice and protected CARLOS SIMPSON™ brand. The website presents original artworks, publications, art-related products, commissions, research and other creative work.
References in these Terms to “Carlos Simpson Art”, “we”, “us” or “our” mean the Carlos Simpson Art website and the relevant Carlos Simpson contracting or rights-holding party identified in the applicable order, invoice, written licence or project agreement.

Carlos Simpson is the person and creator. CARLOS SIMPSON™ is a protected brand identity. Carlos Simpson Art is the art-facing website and creative practice. Brand and rights information is maintained separately within the site’s legal and trademark resources.
Eligibility, accounts and accurate information
You must provide accurate and current information when placing an order, creating an account, submitting a commission enquiry or otherwise using a service that requires identification or contact details.
- You are responsible for keeping account credentials confidential.
- You must not create an account using another person’s identity without lawful authority.
- You should notify us promptly if you believe your account or order information has been compromised.
- We may require reasonable information to verify an order, payment, commission or rights request.
Product information, artworks and availability
We aim to describe products, artworks, publications and services accurately. Product pages may include dimensions, medium, edition information, condition, images, price, availability, provenance or other relevant information.
Original artworks and some limited or specialist items may be unique or available in very small quantities. An item appearing online is therefore not a guarantee that it remains available until an order has been accepted.
Screen settings, photography, lighting and device differences can affect the appearance of colour, texture and scale. Images are intended to support an informed purchase but cannot reproduce every physical characteristic of an original work.
If a material error is identified in a description, availability status or price before a contract is formed, we may correct the error and invite you to proceed on the corrected basis or cancel the affected order and refund any payment already received.
Orders and contract formation
Submitting an order is an offer to purchase the relevant product or service. An automated order acknowledgement confirms that the order has been received; it does not by itself necessarily mean that the order has been accepted.
Unless a product-specific process states otherwise, a contract is formed when we expressly accept the order, confirm dispatch, begin an agreed service, or otherwise communicate acceptance.
We may decline or cancel an order before acceptance where, for example, an item is unavailable, payment cannot be authorised, delivery is not reasonably possible, a material pricing or description error has occurred, or there are reasonable fraud, security or legal concerns. Where payment has already been taken for an order that is cancelled by us, the relevant amount will be refunded.
Prices, payment and transaction information
Prices are shown on the relevant product, service or checkout page. Applicable delivery charges, taxes or other charges will be shown where the website or checkout process requires them.
You must use a payment method that you are authorised to use. Payment may be processed through third-party payment providers, whose own terms and privacy practices may also apply to the processing service they provide.
Where a bespoke commission, licence or professional service requires a deposit, staged payment or separate invoice, the applicable written proposal, quotation or invoice will state the relevant payment arrangement.
Delivery, collection and transfer of risk
Available delivery destinations and charges are shown through the relevant product or checkout process. Where a delivery date or timescale is specifically agreed, we will use reasonable care to meet it.
For consumer purchases, where no different delivery period has been agreed, applicable UK distance-selling rules may require delivery without undue delay and generally within 30 days after the contract is entered into.
Risk in goods normally passes when you, or a person identified by you, takes physical possession of them, subject to any mandatory consumer law and any special rule that applies where you independently appoint a carrier not offered by us.
Please inspect valuable or fragile deliveries promptly. If an item arrives damaged, follow the notification and evidence process set out in the Refund & Returns Policy .
Cancellation, returns, refunds and consumer rights
Nothing in these Terms removes rights that consumers have under applicable law. Where the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 apply to an online purchase of goods, consumers will generally have a statutory 14-day cancellation period, subject to the Regulations and their exceptions.
Carlos Simpson Art’s published Refund & Returns Policy currently provides a 15-calendar-day return period for eligible defective and non-defective products. Where a statutory right provides greater protection, the statutory right applies.
Bespoke, personalised and commissioned work
Statutory cancellation rights may not apply to goods made to a consumer’s specifications or clearly personalised, to the extent provided by law. This does not remove statutory remedies where goods are faulty, not as described or otherwise fail to meet mandatory legal standards.
Digital content
Where digital content is supplied immediately, the checkout or delivery process may request your express consent to supply beginning during the cancellation period and your acknowledgement that the right to cancel may be lost once supply begins, where permitted by law.
These Terms and the voluntary returns policy sit alongside, and do not replace, applicable UK consumer protection law including the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013.
Commissions and bespoke creative work
Commission enquiries can be made through the Commission a Work by Carlos Simpson page or the official contact route.
A commission may involve a separate written brief, quotation, proposal, deposit, schedule, approval process or licence. Those agreed terms form part of the contract for that project.
- Creative direction, medium, scale, subject, schedule and deliverables should be agreed before work begins.
- Revision or approval stages apply only where they are included in the agreed commission terms.
- Delay caused by missing information, approvals or materials from the client may affect the schedule.
- Ownership of a physical commissioned artwork does not automatically transfer copyright or reproduction rights.
Commissioned and personalised works are normally treated differently from standard stock items for cancellation and return purposes. The applicable written commission terms and mandatory law govern the specific project.
Intellectual property, artworks and copyright
Unless a different rights statement is expressly provided, original artworks, artwork images, text, publications, designs, graphics, photographs, audiovisual material, brand assets and other original content on this website remain protected by copyright, trademark law and other applicable intellectual-property rights.
Purchasing a physical artwork, print, publication or other product does not by itself transfer copyright, reproduction rights, merchandising rights, image licensing rights or other intellectual-property rights.

Acceptable website use, automated access and AI systems
You may browse, link to and use public pages for ordinary lawful purposes. You must not use the website in a manner that damages, disrupts, overloads, compromises or unlawfully extracts from the website, its systems or the rights of others.
Without prior written permission, you must not:
- circumvent access controls, security measures or technical restrictions;
- conduct systematic scraping, harvesting, mirroring or bulk extraction outside ordinary search indexing and lawful technical access;
- republish, sell, sublicense or commercially exploit protected site content;
- remove copyright, trademark, attribution, metadata or rights notices; or
- use protected artworks, artwork images or related content for AI training, fine-tuning, dataset creation, synthetic derivative generation or equivalent machine-learning use where the applicable rights policy requires written permission.
Ordinary search-engine discovery and indexing are treated separately from commercial content licensing or AI model training, as explained in the site’s rights policy.
Enquiries, submissions and materials you provide
When you send an enquiry, commission brief, licensing request, review information or other material, you confirm that you have the right to provide that material and that doing so does not knowingly infringe another person’s privacy, confidentiality or intellectual-property rights.
Do not send confidential, commercially sensitive or unpublished third-party material unless an appropriate confidential process has been agreed in advance.
Information submitted for an order, commission or enquiry may be used as reasonably necessary to respond to the request, administer the transaction, provide the service, maintain appropriate records and meet legal obligations, subject to the applicable privacy information.
Third-party websites, platforms and services
The website may link to, embed or rely upon services operated by third parties, including payment providers, social platforms, video services, publishing platforms, delivery providers and external reference sources.

Artwork prices, previous sales, provenance information or commentary do not amount to a guarantee of future market value, resale value, investment return or availability.
External quotations, references and contextual materials remain subject to their own source context and third-party rights where applicable.
Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any mandatory consumer right that cannot lawfully be excluded.
For consumers, we are responsible for losses that are a foreseeable result of our breach of contract or failure to use reasonable care and skill, subject to applicable law. We are not responsible for losses that were not reasonably foreseeable when the contract was formed.
Where the website or a transaction is used wholly or mainly for business purposes, liability for indirect or consequential business losses, lost profits, lost opportunity or loss of anticipated savings is excluded to the extent permitted by law, unless a separate written business agreement states otherwise.

Can I return an online purchase from Carlos Simpson Art?
Eligible products are currently covered by the published 15-calendar-day Refund & Returns Policy. Statutory consumer cancellation and faulty-goods rights may also apply. Bespoke or personalised items can be subject to different cancellation rules.
Does buying an original artwork transfer the copyright?
No. Unless a separate written agreement expressly says otherwise, purchasing the physical artwork does not transfer copyright, reproduction, merchandising or image-licensing rights.
Are commissioned artworks returnable?
Commissioned or personalised works are normally subject to the specific commission agreement and may fall outside the standard cancellation right where the law provides an exception for personalised goods. Mandatory rights concerning faulty or misdescribed work remain unaffected.
When does an online order become a contract?
Placing an order is an offer to buy. An automated acknowledgement confirms receipt. Unless the purchase flow states otherwise, the contract is formed when the order is expressly accepted, dispatch is confirmed or the agreed service begins.
Can Carlos Simpson artwork images be used for AI training?
Not without prior written permission where the Artwork Rights, Image Licensing & AI Use Policy requires a licence. Ordinary search indexing is treated separately from commercial AI training, dataset creation and synthetic derivative generation.
Which law governs these Terms and Conditions?
The Terms are governed by the laws of England and Wales, subject to mandatory consumer protections and any right a consumer may have to bring proceedings in another competent jurisdiction.
